Who Is Legally Allowed to File a Wrongful Death Lawsuit in Kentucky?Young Driver Killed in Head-On Crash on U.S. 42 Near U.S. 127

In Kentucky, only certain individuals have legal authority to file a wrongful death lawsuit after a fatal crash. In most cases, the personal representative of the deceased person’s estate must bring the claim. This representative often acts on behalf of surviving family members.

Kentucky law allows the spouse, children, or parents of the deceased to benefit from a wrongful death claim. If the victim had a surviving spouse, that person may receive priority when damages are distributed. Children may also have the right to recover losses connected to the death of a parent.

When there is no spouse or child, the victim’s parents or other close relatives may become eligible under state rules. Each case depends on family structure and estate appointments. Courts often require proper paperwork to establish who has authority to file.

A wrongful death lawyer can help families understand who may qualify and what steps are required. An attorney can explain deadlines, review documents, and discuss what types of compensation may be available, including funeral expenses or lost financial support.
