What to Do After a Fatal Workplace Accident in KentuckyEmployee Killed in Workplace Accident at Firestone Plant on Fireston Blvd

After a fatal workplace accident in Kentucky, families should report the incident to the employer, request official documentation, and review workers’ compensation and potential wrongful death options. Taking early steps helps preserve records and clarify what benefits may apply. Understanding the legal process can help families make informed decisions during a difficult time.

Kentucky law requires employers to carry workers’ compensation insurance. In fatal cases, surviving dependents may qualify for death benefits through the workers’ compensation system. These benefits can include funeral expenses and a portion of the worker’s average weekly wages. Filing deadlines apply, so timely notice is important.

In some situations, a third party may have contributed to the accident. For example, defective equipment or outside contractors can play a role in a serious incident. When that happens, families may have the option to pursue a separate wrongful death claim in addition to workers’ compensation benefits.

Preserving documentation is critical. Families should request incident reports, safety records, and any findings from workplace investigations. Medical records and coroner reports also help establish the cause of death and the circumstances surrounding the accident.

A wrongful death attorney can review employment records, insurance policies, and investigative findings to explain what legal options may be available under Kentucky law.
