Can Firefighters Seek Compensation After Being Injured on the Job in Rockcastle Co., KY?Firefighter Hurt in Collision on I-75 in Rockcastle Co., KY

Yes. Firefighters injured while on duty are generally entitled to workers' compensation benefits, which can cover medical expenses and a portion of lost wages during recovery. But workers' compensation is not always the only avenue available. When a third party is responsible for the injury, a separate personal injury claim may also be possible alongside any workers' comp benefits already received.

That distinction matters significantly in a case like this one. A driver who fails to move over for emergency vehicles on an active scene may bear direct civil liability for any injuries that result. Kentucky's Move Over law requires drivers to change lanes or slow down when driving along stopped emergency vehicles with lights activated. A violation of that law can serve as important evidence in a personal injury claim, separate from any criminal or traffic charges the driver may face.

The overlap between workers' compensation and a third-party claim can be complicated. In some cases, an employer or insurer may have the right to recover a portion of what they paid out if a civil claim succeeds. A personal injury attorney can help a firefighter or their family understand how these two tracks interact and what the realistic outcome of pursuing both might look like.
