When a pedestrian is killed by a vehicle in Kentucky, surviving family members may have the right to file a wrongful death claim against the at-fault driver. Under Kentucky law, eligible family members can include a spouse, children, or parents of the deceased. A wrongful death claim is separate from any criminal case and focuses on the financial and personal losses the family has suffered. Even when a criminal investigation is active, a civil claim can move forward independently.
In Kentucky, the stretch near Park Road and Leroy Avenue sees consistent pedestrian activity, particularly around retail and gas station clusters where foot traffic and vehicle movement converge. These roads are characterized by the speed, limited lighting, and frequent curb cuts that create dangerous conditions for people on foot.
Families who lose a child or loved one in a pedestrian crash can face devastating financial consequences alongside their grief. Funeral costs, lost future income, and the immeasurable loss of companionship are among the damages that may be recoverable under Kentucky wrongful death law.
The state's statute of limitations for wrongful death claims is generally one year from the date of death, which makes timely legal consultation important. A wrongful death attorney can help a grieving family understand what options may be available and what the process looks like from the start.
