State law typically allows a personal representative of the deceased person’s estate to bring the claim on behalf of surviving family members. This representative often seeks compensation for losses connected to the death.
A wrongful death claim may address funeral costs, medical expenses related to the final injury, and lost income the person would have provided. In some cases, the law may also consider the loss of companionship or support.
Each claim depends on the facts of the accident and the available evidence.
Kentucky follows a pure comparative fault system. That means courts may examine the actions of all drivers involved in a multi-vehicle collision. The percentage of fault assigned to each party can affect potential compensation. For this reason, crash reconstructions and witness statements often play a key role in these cases.
A wrongful death attorney can review police reports, medical records, and insurance policies to explain how Kentucky law applies. Legal guidance may help families understand filing deadlines, which generally require action within a set time frame.
