What Happens After a Passenger Dies in a Kentucky Motorcycle CrashTwo People Killed in Motorcycle Crash at Winchester Ave & 25th St

When a motorcycle passenger dies in a crash in Kentucky, their surviving family members may have the right to file a wrongful death claim against the party responsible for the accident. Kentucky law allows eligible family members to pursue compensation for the losses that follow a fatal crash, and acting quickly helps preserve important evidence.

Kentucky operates under a choice no-fault insurance system, which means drivers choose between no-fault and traditional tort coverage when purchasing a policy. For motorcycle riders and their passengers, however, personal injury protection benefits do not automatically apply the same way they do for car occupants.

Investigators and attorneys examine factors such as road conditions, traffic patterns, and driver behavior to help establish responsibility.

Under Kentucky's wrongful death statute, surviving family members may seek compensation for funeral and burial expenses, lost future income, and the loss of companionship and support. Kentucky follows a pure comparative fault rule, meaning that liability can be shared between parties, and compensation may be adjusted based on each party's degree of fault. A wrongful death lawyer can review the details of the crash and help families understand what options may be available given the specific circumstances of the case.

At Byrnes Law Office, we have years of experience reviewing wrongful death and motorcycle accident cases throughout Kentucky.
