Who Can File a Wrongful Death Claim After a Fatal Crash in Jessamine County, KY?Double Fatal Crash on Union Mill Rd Kills Two in Jessamine Co, KY

In Kentucky, the right to file a wrongful death claim initially belongs to the personal representative of the deceased person's estate, typically an individual appointed by a court to act on behalf of the estate. The representative files the claim, but any compensation recovered is distributed to the surviving family members in accordance with Kentucky law.

In most cases, this means a spouse, children, or parents of the person who died. When two people are killed in the same collision, as happened here, each family may have a separate wrongful death claim that proceeds independently.

Kentucky's statute of limitations for wrongful death claims is generally one year from the date of death, which is a significantly shorter window than the deadline for standard personal injury claims. This compressed timeline makes it especially important for surviving family members to seek legal guidance promptly. Key evidence, including vehicle condition, road markings, and witness accounts, can deteriorate or disappear quickly in the weeks following a fatal crash on a rural road.

A wrongful death attorney can help a family understand who is eligible to file, what the claim process involves, and what types of compensation may be available. Possible compensation includes loss of future income, loss of companionship, and funeral expenses.
