Does a Police Report Affect a Wrongful Death Lawsuit in Louisville, KY?One Dead After Crash on Crittenden Dr in Louisville, KY

A police report can play a meaningful role in a wrongful death case, but it is not the final word on fault. In Kentucky, a police report is considered an official document that records the responding officer's observations, witness statements, and any preliminary conclusions about what caused a crash. Insurance companies and attorneys on both sides will review it carefully. If the report assigns fault to a particular driver, that finding can influence how a claim is evaluated. However, it does not bind a court, and it can be challenged with additional evidence.

In Kentucky, a wrongful death claim must be filed by the personal representative of the deceased person's estate, typically within one year of the date of death. The claim can seek compensation for medical expenses prior to death, funeral costs, lost future earnings, and the loss of care and companionship the deceased would have provided to their family.

Even when a police report points to shared fault, Kentucky's pure comparative fault system means a family may still recover damages. Yet, the amount is reduced based on the deceased's percentage of responsibility.

In some cases, a police report may contain errors or reflect incomplete information gathered under time pressure. A Louisville wrongful death attorney can review the report alongside other available evidence and identify whether the official account tells the full story. If the report underrepresents another driver's role in the crash, a lawyer can build a stronger evidentiary record that can be critical to the outcome of a wrongful death lawsuit.
