A wrongful death claim is a legal action that certain family members can file when a person dies as a result of another party's negligence. In Kentucky, if a fatal crash occurs because a driver acted carelessly or recklessly, the surviving family may have the option to pursue a wrongful death claim to seek compensation for their loss. This type of claim exists separately from any criminal charges that authorities may file against the at-fault driver.
Kentucky law designates who can file a wrongful death claim. Typically, the personal representative of the deceased person's estate brings the claim on behalf of surviving family members. Spouses, children, and parents may be eligible to recover damages depending on the circumstances. Compensation in these cases can cover funeral and burial expenses, lost future income, and the loss of companionship and guidance that the deceased provided to their family.
Kentucky also imposes strict deadlines on wrongful death claims. Families generally have one year from the date of death to file a claim, making it important to seek legal guidance as soon as possible. A wrongful death attorney can review available evidence, explain how Kentucky wrongful death law applies to a specific situation, and help families understand what options may be available to them.
